Tuition – Veterans/Dependents In-State Rate, BP 5.100

1. Purpose


To ensure compliance with Section 1005 of the Isakson and Roe Veterans Healthcare and Benefits Improvement Act of 2020 (PL 116-315), which is an update to Section 3679(c) of title 38, United States Code, including PL 115-251, also known as the Veterans Access, Choice, and Accountability Act of 2014 (Choice Act) which requires the Department of Veteran Affairs to disapprove programs of education for payment of benefits under the Post-9/11 GI Bill (Chapter 33), and Montgomery GI Bill-Active Duty (Chapter 30), and Veterans Readiness and Employment (Chapter 31) at public institutions of higher learning if the schools charge qualifying veterans and dependents tuition and fees in excess of the In-State rate.


2. Scope


Applies to any qualifying veteran and qualifying dependents of veterans (children/spouses).


3. Prerequisites


The U.S. Department of Veterans Affairs (VA) established requirements to ensure that our Nation’s recently discharged Veterans, and their eligible family members, would not have to bear the cost of Out-of-State charges while using their well-deserved education benefits. The State of Michigan submitted policy language which was approved and adopted by the VA for public institutions of higher education that offer VA approved programs.

To remain compliant and approved to receive VA’s GI Bill programs funding, schools must charge In-State tuition and fee amounts to “covered individuals.” A “covered individual” is defined in Section 1005 of Public Law 116-3151 as:

  • A Veteran who lives in the state in which the institution of higher education is located (regardless of their formal state of residence) and enrolls in the school regardless of when they discharged from military service.
  • A spouse or child using transferred benefits who lived in the state in which the institution of higher learning is located (regardless of their formal state of residence) and enrolls in the school regardless of when the military member discharged from military service.
  • A spouse or child using benefits under the Marine Gunnery Sergeant John David Fry Scholarship who lives in the state in which the institution of higher learning is located (regardless of their formal state of residence) and enrolls in the school regardless of when the military member died in the line of duty.

Any individual using VA Educational Benefits under Chapter 30, Chapter 31, Chapter 33, Chapter 35, or the Fry Scholarship and who lives in the State of Michigan while attending Lansing Community College, regardless of their former state of residence, and regardless of when they or the military member was discharged from military service, will pay In-State tuition rates for all VA approved programs.


4. Responsibilities


  • Registrar’s Office – Identify eligible veteran and dependent students, process residency forms, and complete updates to residency status. Communicate with Center for Veteran and Family Support (CVFS) for possible eligible change in residency status students. 
  • Center for Veteran and Family Support – Maintain necessary documentation from students and ensure SIS is updated with appropriate attributes and codes for Registrar reporting; communicate with eligible students to submit proper Residency form and documentation; submit certification adjustments to VA to correct tuition and fee totals when necessary.
  • Student - Responsible for submitting the necessary documentation to CVFS in order to verify student status; ensure that personal address on record is up to date; submit a Declaration of Residency Form with the appropriate documentation, when requested.


5. Procedure


  1. Student submits documentation to CVFS to verify student status as a veteran or dependent of a veteran. Student will also ensure personal address on file is up to date. 
  2. CVFS codes students, based on status, in SIS in order to complete reporting and conduct necessary outreach.
  3. Registrar’s Office completes regular and frequent residency reports, specifically for veteran students, in order to locate discrepancies in residency status and address on record.
    1. Students who were out of state, now in state, will be updated by Registrar’s Office.
  4. Registrar’s Office communicates student list to CVFS for possible in-district residency requirement waiver. 
  5. CVFS communicates to possible eligible in-district students to submit a new Declaration of Residency form. 
    1. Registrar’s Office waives residency requirement of 4 months established residency.
  6. If residency is updated and refund is processed due to change in tuition rate, CVFS will submit a certification adjustment to the VA to correct the tuition and fee totals.
