Title IX is a federal civil rights law that prohibits discrimination on the basis
of sex in education programs and activities. In accordance with Title IX of the Education
Amendments, LCC prohibits sex discrimination, including sexual misconduct and sexual
Sexual harassment is conduct on the basis of sex that satisfies one or more of the following: (1) An employee of LCC conditioning the provision of an aid, benefit or service of LCC on an individual’s participation in unwelcome sexual conduct; (2) Unwelcome conduct determined by a reasonable person to be so severe, pervasive and objectively offensive that it effectively denies a person equal access to LCC’s education program or activity; or (3) Instances of sexual assault, dating violence, domestic violence or stalking.
Under Title IX:
An institution must adopt and publish a policy and grievance process that provides for a fair, consistent, reliable and reasonably prompt resolution of complaints of sex discrimination, including sexual harassment, and furnish the name of the Title IX Coordinator(s) responsible for ensuring an equitable process. Reports of sexual misconduct or sexual harassment may be made to the Title IX Coordinator, to the college, to law enforcement, to any of those or to none of those. Anyone experiencing unlawful discrimination or harassment can also file a complaint with other agencies, whether or not they have chosen to do so with the college or with law enforcement.
A complainant may submit a report to the Title IX Coordinator in person, by phone, by mail, by email or through electronic form. A formal complaint made under Title IX should also include a statement on the part of the complainant as to whether the complainant requests the college to commence an investigation into the alleged matter. Supportive measures are available to individuals regardless of whether they file a formal complaint. A report may be submitted to the LCC Public Safety Department and/or the U.S. Department of Education, Office of Civil Rights.
Most times, the LCC grievance process is the quickest way to resolve an issue. A criminal investigation into allegations of sexual harassment/sexual violence does not relieve the school of its duty under Title IX to resolve complaints promptly and equitably.
When an incident of sexual harassment or misconduct is reported, regardless of whether the alleged complainant is the individual who reported the incident, the college will respond promptly to the alleged sexual harassment or misconduct in a manner that is not deliberately indifferent, which means a response that is not clearly unreasonable in light of the known circumstances.
All students, employees and third parties are encouraged to report all incidences of sexual harassment and misconduct.
